PART II: Privacy Policy (Datenschutzerklärung)
1. General Scope & Data Controller
This privacy policy explains the nature, scope, and purpose of the collection and use of personal data on this website in accordance with the EU General Data Protection Regulation (GDPR / DSGVO). The data controller is the individual listed in Part I.
2. Collection and Storage of Personal Data
We collect and process data in our centralized database (SQLite) for the following purposes:
- Account Creation (Art. 6(1)(b) GDPR): To provide you with access to the Mavica Network, we store your chosen username, email address, and a securely hashed password.
- Public Profile Data (Art. 6(1)(a) GDPR): Any additional information you actively provide in your profile settings (such as display name, pronouns, gender, location, gear, "about me" texts, and external links) is completely voluntary. By entering this data, you consent to its public display across the network.
- Communication & Social Features: Data you generate through interactions—including Private Messages (PMs), Shoutbox chats, Network Stream posts, Comments, "+1" interactions, and Guestbook entries—are stored to facilitate these community features. Private messages are strictly limited to the sender and recipient.
3. Uploaded Files, Media & Metadata
Public Galleries & Streams: All images, videos, and media files uploaded to your public directories, Webrings, or the Network stream are publicly accessible.
EXIF Data Warning: Please be aware that EXIF data (metadata) such as camera model, exposure settings, and potentially GPS coordinates are automatically extracted and stored along with your files. You are solely responsible for stripping any highly sensitive metadata prior to uploading.
4. Temporary Tools (Converter & File Transfer)
- File Converter: Files uploaded to the Media Converter tool are processed in a temporary workspace and are automatically and permanently deleted from our servers immediately after the conversion process is finished.
- File Transfer Hub: Files uploaded to the direct "File Transfer" system are strictly temporary. They are automatically destroyed and permanently removed from our storage arrays exactly 24 hours after upload.
5. Server Logs & Analytics
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us (Art. 6(1)(f) GDPR). These include: browser type/version, operating system, referrer URL, hostname of the accessing computer, and time of the server request. This data is not merged with other data sources and is used strictly for security monitoring and abuse prevention.
6. Session Cookies
We exclusively use technically necessary session cookies (e.g., connect.sid) required to maintain your login status and ensure the core functionality of the website. These cookies are exempt from consent requirements under the TTDSG/TDDDG. Absolutely no tracking, marketing, or third-party analytics cookies are deployed.
7. Your Rights under the GDPR
You have the right to obtain free information about your stored personal data, its origin, recipients, and the purpose of data processing at any time (Art. 15 GDPR). You also have the right to request the rectification (Art. 16), blocking (Art. 18), or eradication (Art. 17) of this data. Furthermore, you can revoke your consent to data processing at any time. To exercise these rights, or to request the complete deletion of your account and all associated files, please contact the operator via the email address provided in the imprint.
PART III: Terms of Service & Disclaimer
1. Content Ownership & License
By uploading images, videos, text, or other media, you confirm that you hold the necessary copyrights and permissions. You retain full ownership of your content. However, by uploading, you grant this platform a non-exclusive, royalty-free license to host, display, process, and format your content for the purpose of operating the website.
2. Prohibited Conduct
The upload, sharing, or linking of the following content is strictly prohibited:
- Illegal, extremist, or violence-glorifying material.
- Pornographic or sexually explicit content.
- Copyrighted material belonging to third parties without explicit permission.
- Malicious software, scripts, viruses, or intentional spam.
We reserve the right to instantly terminate accounts, delete files, and ban users who violate these terms without prior notice.
3. Liability for User Content (Notice and Takedown)
As a service provider, we are responsible for our own content on these pages under general law. However, we are not obligated to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity. Liability for user-generated content only arises from the exact moment we gain knowledge of a specific legal violation. Upon notification of such violations, we will remove the content immediately.
4. Liability for External Links
Our platform contains links to external websites of third parties. We have no influence on the contents of these websites and therefore cannot assume any liability for them. The respective provider or operator of the pages is always responsible for the content of the linked pages. If we become aware of any legal infringements on linked pages, we will remove such links immediately.
